Dear User,

this document (hereinafter, the "Information Notice") sets out and lists the methods of data processing that the company WeShort S.r.l. collects and processes when you navigate on its website at the current address www.weshort.com (hereinafter, the " Website"). In this regard, please note that the Information Notice only governs the processing of data relating to the Website, expressly excluding any further processing that may occur as a result of third party websites consulted by the user through links contained in the Website.

1. Titolare del trattamento (Processing owner?) 

La società WeShort S.r.l., con sede legale in 70125 - Bari, alla Via Alcide De Gasperi n. 314/A, C.F. e P.IVA n. 08510540720 (di seguito, “WeShort”), è il titolare del trattamento dei dati, nella figura del proprio rappresentante pro-tempore sig. Alessandro Loprieno (o, ove dovesse essere modificata la forma di governance, del soggetto che avrà la rappresentanza di WeShort).

In qualità di titolare del trattamento dei dati personali raccolti durante la navigazione delle varie sezioni e sottosezioni del Sito, WeShort si impegna a garantire il rispetto della disciplina in materia di privacy, come modificata dal Regolamento dell’Unione Europea n. 679/2016 (di seguito, “GDPR”) e dal D. Lgs. 10 agosto 2018, n. 101 (di seguito, il “Decreto Legislativo”) fornendo ai propri utenti tutte le relative informazioni sia in merito alle modalità di raccolta, archiviazione ed utilizzo dei predetti dati che per quanto riguarda i diritti di ciascun utente.

2. Personal data processed, purpose and legal basis for processing 

A. Personal data processed

WeShort collects and stores the following data:

- the user's first and last name;

- the user's phone number;

- the user's email address;

- the content of the message (including, but not limited to, any information sent voluntarily by the user such as, but not limited to, questions to user support, answers to surveys and/or other optional information).

This data is considered to be voluntarily provided by the user at the time of the contact request. Consequently, the user, by simply voluntarily and knowingly entering the data mentioned above in the "Contact us" form on the WeShort platform or in the email that he/she sends to WeShort's email address, authorises WeShort to process such data only for the purposes set out in this Information Notice (i.e. contacting the user and replying to his/her request, therefore, only for correspondence purposes).

In addition to the above (first name, last name and e-mail address of the user), WeShort also collects and stores the following data of users who register on the Website:

- username and password.

This data is understood to be voluntarily provided by the user at the time of the registration procedure on the Website through the "Register" form. Consequently, the user - by voluntarily and knowingly entering the aforesaid data in the registration procedure required to access the Website as a registered user and take benefit, as such, of the services offered by the platform - authorises WeShort to process such data only for the purposes set out in this Information Notice (i.e. user registration and execution of the services offered to the registered user, i.e. the services accessible only with credentials).

In addition to the above, it should be noted that the Website, as is the practice of many websites, makes use of log files in which information collected in an automated manner during user visits is stored. The information collected may concern:

- the Internet Protocol (IP) address

- the type of operating system, browser and device parameters used to connect to the Website;

- the name of the internet service provider (ISP); 

- the settings, date and time of visit/use;

- the location (meaning the geo-location of the user) and the language used;

- the geographical area in which the device from which the data subject to this Policy is communicated is used and/or the different mobile devices used by the user from time to time

- the user's web page of origin (referral) and exit;

- (possibly) the number of clicks.

B. Purpose and legal basis of processing

The personal data requested by WeShort are collected and processed in order to: (i) contact the user who, by filling in the contact form present on the "Contact Us" page, sends a message to the e-mail address [email protected] and enters in the form its own data requesting to be contacted; and (ii) register the user in order to be able to provide the services accessible to the user only with the credentials, i.e. offered only to the registered user who, by filling in the "Registration Procedure" present on the "Register" page of the website, enters in the form its own data requesting to be registered to the WeShort website.

Any additional data (such as, but not limited to, domain names, IP addresses and/or browser types) collected through the Website are and/or will be used to track traffic statistics and for the purposes of monitoring how the services are used by the competent authorities and are and/or will be in no way accompanied by any additional personal information that is not strictly necessary for the purposes specified therein.

Therefore, the legal basis for the processing of:

- dati personali forniti volontariamente tramite il form “Contattaci”, è l’adempimento del contratto (art. 6, co. 1, lett. b) del GDPR) o, a seconda dei casi il perseguimento del legittimo interesse del titolare del trattamento (art. 6, co.1, lett. f) del GDPR);

- dei dati personali forniti per utilizzare servizi accessibili con delle credenziali, è l’adempimento del contratto (art. 6, co. 1, lett. b) del GDPR) o, a seconda dei casi, l’adempimento di un obbligo legale al quale il Titolare è soggetto (art. 6, co. 1, lett. c) del GDPR);

- dati di navigazione è il perseguimento del legittimo interesse del titolare del trattamento (art. 6, co. 1, lett. f) del GDPR).

3. Nature of provision

The provision of data by the user for the purposes referred to in Article 2, letter B., is absolutely necessary in order to allow WeShort to: (i) contact the user and answer questions and/or requests made by the user by filling in the contact form on the "Contact Us" page, with which the user sends a message to the e-mail address [email protected] and (ii) register the user in order to provide him with the services accessible only with credentials. Any refusal of the user to provide his/her data will make it impossible for WeShort to reply to the relevant contact request or to the relevant request for registration and provision of a service offered only to registered users, without this giving rise to any liability on behalf of WeShort.

Where necessary, WeShort may ask users for specific consent to send periodic newsletters/s and/or advertising and/or marketing and/or profiling material by email. In particular, marketing activities are intended to make WeShort's services and contents known to interested persons who have given their consent to data processing, while profiling activities are carried out to measure the results of marketing campaigns. In this case, the provision of data by the user is optional and its use is conditional on the user's explicit consent. Any refusal by the user to grant consent does not affect the possibility to browse the Website and has no effect other than to exclude the sending of newsletters/s and/or advertising material.

4. Data processing methods 

The data collected will be processed through the use of electronic, computerised and telematic automated tools and/or through manual processing with logic strictly related to the purposes for which the personal data were collected guaranteeing, in any case, their security.

The aforementioned data will be stored on computerised media, in compliance with the security measures and safeguards suggested by the GDPR.

The processing of personal data is carried out by means of the operations indicated in Article 4, no. 2, of the GDPR, namely: collection, recording, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, deletion and destruction of data.

All data is stored using a WeShort server farm which is located in a data centre of the latest generation, which is highly secure and in any case in line with legal requirements. In order to prevent the misuse of such data, WeShort takes some specific security precautions, such as storing confidential data in an encrypted format.

5. Data Access

Oltre al titolare, i dati potranno essere resi accessibili per le finalità indicate negli articoli 1, 2, 3 e 4 che precedono, in qualità di “Responsabili del Trattamento” ai sensi dell’articolo 4, n. 8, del GDPR, a:

• personale interno di WeShort coinvolto nell'organizzazione del sito (come, a titolo esemplificativo ma non esaustivo, personale amministrativo, commerciale, marketing, legali, amministratori di sistema), a tal fine individuato ed autorizzato al trattamento secondo specifiche istruzioni impartite nel rispetto della normativa vigente;

• a terzi soggetti (come, a titolo esemplificativo ma non esaustivo, studi professionali e/o consulenti esterni, fornitori di servizi tecnici terzi, corrieri postali, hosting provider, società informatiche, agenzie di comunicazione) che svolgono attività di assistenza e consulenza  per conto di WeShort e che saranno, di volta in volta, nominati nella loro qualità di responsabili esterni del trattamento, solo per le finalità strettamente necessarie all’utilizzo degli stessi;

• a società che svolgono servizi connessi e strumentali all’esecuzione delle finalità sopra indicate.

WeShort tratta i dati degli utenti in maniera lecita e corretta, adottando le opportune misure di sicurezza volte ad impedire accessi non autorizzati, divulgazione, modifica o distruzione non autorizzata dei dati. Il trattamento viene effettuato mediante strumenti informatici e/o telematici, con modalità organizzative e con logiche strettamente correlate alle finalità indicate.

WeShort si impegna a non utilizzare né condividere, anche per il futuro, i dati personali in modo non conforme a quanto descritto nella presente Informativa senza informare l’utente di volta in volte interessato, concedendogli l’opportunità di rifiutare esplicitamente il consenso per attività diverse da quelle quivi descritte e prevenendo l’utilizzo non conforme dei predetti dati.

6. Processing duration 

The duration of the processing will be limited to the time necessary to fulfil legal obligations, resolve disputes and enforce any concluded agreements. Therefore, the data will be kept for the period of time necessary to achieve the purposes for which the data were collected.

In particular, in relation to the management of the existing contractual relationship, the data will be kept for the timeframe defined by the reference legislation as well as, upon termination of the relationship, for the ten-year term for the storage of civil law data only.

The user may, at any time, request the rectification, limitation and/or cancellation of data by sending a request to: [email protected]. In this case, the provisions of Article 3 above shall be applied.

7. Data transfer 

The management and storage of Personal Data will take place on servers owned by WeShort and/or third party companies specifically appointed by WeShort and duly appointed as data processors. These servers will be located within the territory of the European Union.

Specifically, all personal data are stored within the European Economic Area (also referred to as 'EEA'), and specifically they are stored on servers by Google Cloud.

However, this does not preclude that some of the data collected on the Website may be shared with services located outside the European Union and, in particular, with Google, Facebook and Microsoft (LinkedIn) via social plug-ins and the Google Analytics service.

In this case, WeShort guarantees that the relevant transfer takes place in absolute compliance with the specific provisions of Article 45, paragraph 1, of the GDPR, so no further consent is required. In any case, it is understood that, where Article 45, paragraph 1, of the GDPR is not applicable, such transfer will in any case take place in compliance with the regulations provided for in Article 45 et seq. of the GDPR, since the transfer of data to third countries that do not observe the aforementioned regulations provided for by the GDPR is expressly excluded.

8. Diritti dell’interessato

Article 13, paragraphs 1 and 2, of the GDPR lists the necessary information that the user must receive from the data controller at the time the data are obtained in order for the latter to guarantee the correct and transparent processing of the data.

A tal proposito, ogni utente, nella propria qualità di soggetto “interessato”, ha i diritti di cui agli articoli 15 e seguenti del GDPR e, precisamente, i diritti:

• di ottenere la conferma dell’esistenza o meno di dati personali che lo riguardano negli archivi di WeShort, anche se non ancora registrati, e la loro comunicazione in forma intelligibile;

• di ottenere l’indicazione: a) dell’origine dei dati personali; b) delle finalità e modalità del trattamento; c) della logica applicata in caso di trattamento effettuato con l’ausilio di strumenti elettronici; d) degli estremi identificativi del titolare, dei responsabili e del rappresentante designato ai sensi dell’articolo 3, comma 1, del GDPR; e) dei soggetti o delle categorie di soggetti ai quali i dati personali possono essere comunicati o che possono venire a conoscenza dei predetti dati in qualità di rappresentanti designati nel territorio dello stato italiano, di responsabili o incaricati; f) del periodo di conservazione dei dati personali, o se non è possibile prevederlo, dei criteri utilizzati per determinare tale periodo;

• di ottenere la rettifica o l’integrazione dei dati personali (articolo 16 del GDPR) o la loro cancellazione (“diritto all’oblio” articolo 17 del GDPR) o la limitazione del trattamento dei dati personali che lo riguardano (articolo 18 del GDPR) e che, in ognuno di questi casi, le eventuali operazioni (di rettifica, cancellazione o limitazione) siano comunicate dal titolare del trattamento a ciascuno dei destinatari cui sono stati trasmessi i dati personali, eccettuato il caso in cui tale adempimento si riveli impossibile o comporti uno sforzo sproporzionato (articolo 19 del GDPR);

• di ricevere in un formato strutturato, di uso comune e leggibile da dispositivo automatico i tuoi dati e di trasmettere, ove tecnicamente possibile, tali dati a un altro titolare del trattamento - “diritto alla portabilità dei dati” (articolo 20 del GDPR);

• di opporsi, in tutto o in parte, in qualsiasi momento: a) per motivi legittimi connessi alla sua situazione particolare, al trattamento lecito e necessario dei dati personali che riguardano l’utente per l’esecuzione di un compito svolto nel pubblico interesse o nell’esercizio di pubblici poteri dal titolare del trattamento, ovvero per i legittimi interessi del titolare del trattamento o di terzi,  (articolo 21, comma 1, del GDPR); b) per finalità di marketing diretto, al trattamento di dati personali che riguardano l’utente (articolo 21, comma 2, del GDPR) - per entrambi i casi di cui alle lettere a) e b) è compresa la profilazione (come definita dall’art. 4. n. 4) del GDPR) a loro connessa;

• di non essere sottoposto a una decisione basata solo sul trattamento automatizzato dei dati, compresa la profilazione, che produca effetti giuridici che riguardano l’utente o che comunque incida significativamente sulla sua persona, eccettuati i casi in cui la decisione si basi sul consenso esplicito dell'interessato, sia necessaria per l’esecuzione di un contratto con l’interessato, ovvero sia autorizzata dal diritto dell'Unione o del singolo Stato membro (articolo 22 del GDPR);

• di proporre reclamo ad un’autorità di controllo ovvero all’Autorità Garante per la Protezione dei Dati Personali o, in alternativa, all’Autorità giudiziaria competente (art. 140-bis del D. Lgs. 30 giugno 2003, n. 196, come modificato dall’art. 13 del Decreto Legislativo).

A tal proposito, WeShort fa presente che il diritto di opposizione dell’interessato, come sopra esposto, per finalità di marketing diretto mediante modalità automatizzate si estende anche al marketing tradizionale. In ogni caso, resta salva la possibilità per l’interessato di esercitare il diritto di opposizione anche solo in parte. Pertanto, l’interessato può decidere di ricevere solo comunicazioni (i) mediante modalità tradizionali ovvero (ii) solo comunicazioni automatizzate oppure (iii) nessuna delle due tipologie di comunicazione.

9. How to exercise your rights

As indicated above, the user has, at any time, the possibility to object to the processing of his or her data and/or request the rectification, updating, restriction or deletion of all personal information held by WeShort.

These rights may be exercised by the user by sending a communication to the following e-mail address: [email protected]. 

10. Minors

WeShort's website, as well as the information and services offered therein, are not intended for subjects under the age of 14, in compliance with the provisions of Article 2-quinquies of the Legislative Decree.  For this reason, WeShort will not intentionally collect, use or disclose personal data referring to subjects under the age of 14, provided that, in such a case, the legitimacy of the consent provided by the minor through the authorisation of one of his or her parents or legal guardian will be required.

In the event that information on minors is involuntarily collected, including as a result of misrepresentation on the part of users, WeShort will delete it promptly, at the request of the user and/or, in any event, as soon as it becomes aware of the reason for the deletion.

11. Various

The Policy may be subject to change due to (i) the introduction of new regulations and/or amendments to the GDPR and/or Legislative Decree and/or (ii) changes or updates by WeShort. In this regard, therefore, you are invited to periodically check this page.
